As evident through the reading and work in this lesson, many laws exist focusing on the staffing function illustrating that the consequences can be quite costly for an organization in the form of litigation and/or damaging public relations in the event any of the laws are violated. Anyone who is involved in the hiring process, albeit HR professionals, line managers, hiring managers, etc., all share the role of insuring compliance with the law. Therefore it's important that individuals be educated and trained on proper interviewing and legal compliance before engaging in the talent acquisition process.
Today, with social media tools becoming more commonplace, legal compliance in staffing is even more of a challenge. Organizations will need to be diligent in addressing the use of social media tools, such as LinkedIn and Facebook in the recruitment process, as access to information becomes more open and widespread thus subject to possible legal violation.
As you engage in the activities for this lesson, think about your personal interview experiences. Have you experienced any legal infractions? How would you grade your current (or past) organization when it comes to training, educating and complying with staffing laws? What could be improved based on your newfound knowledge? Given the increasing popularity of social media and technology usage in the talent acquisition process, describe the legal risks associated with social media in recruiting and measures organizations can adopt to reduce the risk of discrimination claims. In your essay, discuss the current definition of "applicant" as defined by the EEOC, privacy considerations in reference checks given the proliferation of information on sites such as Facebook and Twitter and suggestions that you have, based on your research, for organizations and applicants to minimize their risk in this era of open access to information. Your research should include recent court cases and their findings as well as a discussion on the position adopted by the organizations in these cases.
